Make a FOIA Request
The Freedom of Information Act (FOIA) is intended to ensure an informed citizenry through access to public information. Before submitting a FOIA request, make sure that the information you seek is not already in the public domain or located on the Mercer County Commission website or other government sites. If the information is not in the public domain, you may submit your FOIA request easily using the digital FOIA Request Form. If you have any trouble submitting this form, please contact us.
What is the Freedom of Information Act?
The Freedom of Information Act (FOIA) is a federal law that grants the public the right to request access to records from any federal agency.
How FOIA Works
FOIA gives you the right to request any federal agency records, with certain exemptions for information that must be kept confidential to protect privacy or national security.
These exemptions include classified information, personal privacy records, law enforcement records, and trade secrets.
Making a FOIA Request
To request records under FOIA, you generally must submit a written request to the agency that holds the records.
The request should be as specific as possible, clearly identifying the records you are seeking. Agencies are required to respond to FOIA requests promptly and either provide the requested records or explain why they are exempt from disclosure.
FOIA and Mercer County
While FOIA applies to federal agencies, West Virginia has its own version of the law that applies to state and local government agencies, including Mercer County. This means you have the right to request access to public records held by the Mercer County Commission and other county offices.
Why is FOIA Important?
FOIA plays a crucial role in promoting open government and ensuring that citizens have the information they need to hold their government accountable. It allows individuals to: Â
- Monitor government activities: FOIA requests can reveal information about how government agencies operate, make decisions, and spend taxpayer money.
- Investigate wrongdoing: FOIA can be used to uncover evidence of corruption, waste, or abuse of power. Â
- Conduct research: FOIA requests can provide valuable information for journalists, academics, and others conducting research on government activities.
- Protect individual rights: FOIA can help individuals access their own records held by government agencies and ensure that their rights are being protected.
By empowering citizens to access government information, FOIA strengthens democracy and promotes transparency and accountability in government.
