Freedom of Information Act (FOIA) Requests

FOIA gives you the right to request any federal agency records, with certain exemptions for information that must be kept confidential to protect privacy or national security.

These exemptions include classified information, personal privacy records, law enforcement records, and trade secrets.

To request records under FOIA, you generally must submit a written request to the agency that holds the records.

The request should be as specific as possible, clearly identifying the records you are seeking. Agencies are required to respond to FOIA requests promptly and either provide the requested records or explain why they are exempt from disclosure.

While FOIA applies to federal agencies, West Virginia has its own version of the law that applies to state and local government agencies, including Mercer County. This means you have the right to request access to public records held by the Mercer County Commission and other county offices.
