    IN RE: WILLIAM J FARMER, DECEASED.

    On the 13th day of June, 2023 before the Mercer County Commission, came the matter of
    the Estate of William J. Farmer, Sr., deceased, upon motion of Derrick Leffler, Attorney,
    requesting that this estate be returned to the County Commission regarding the removal of the
    personal representative, Jeremiah Farmer, as there have been no agreement between the two
    parties after being tables at the November meeting.
    After a discussion and review of this matter by the Commission, upon proper motion and
    second, and it appearing proper to do so, the Commission ORDERS that Jeremiah Farmer
    remain as Executor to complete the administration of the estate of William J. Farmer, Sr.,
    deceased.
    All od which was accordingly ADJUDGED and ORDERED. The Clerk of this
    Commission is DIRECED to take whatever actions he deems necessary to effectuate this Order,

ASSOCIATION – MC-23-3
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve $16,000 to the Bluewell
Improvement Association. This is application MC-23-3 from Skip Crane. The funds will be used
for decorations for Bluewell.
RE: AMERICAN RESCUE PLAN – WADE CENTER – MC-23-5
This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett,
Commissioner, the Commission voted unanimously to approve $16,799 to the Wade Center.
This is application MC-23-5 from Betty Brainerd. The funds will be used to update fire alarm.

2023 for the Coal Severance Fund in the amount of $405,075.

RE: FINAL BUDGET REVISION FY 2023 – GENERAL COUNTY #4
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve Budget Revision No. 4 for FY
2023 for the General County Fund in the amount of $362,638.
RE: LOVE WHERE YOU LIVE KEEP MERCER CLEAN
This matter has been tabled until August 2023.
RE: FUNDING REQUEST – MERCER COUNTY SHERIFF’S DEPARTMENT
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve a funding request from the
Mercer County Sheriff’s Department for the purchase of three new Ford Escapes for Home
Confinement. Funding in the amount of $95,424 will be taken from the Sheriff’s Budget.
RE: FUNDING REQUEST – MERCER COUNTY FAIR, INC.
This day on motion of Gene Buckner, Commissioner, seconded by Greg Puckett,
Commissioner, the Commission voted unanimously to approve a funding request from the
Mercer County Fair, Inc. to pay for music at the fair. Funding in the amount of $10,000 will be
taken from Hotel/Motel.

RE: EXONERATION OF TAXES – CHELSEA WARD
This day came Chelsea Ward, by representative, and moved the Commission to correct
the Personal Property for 2020, touching the assessment thereon against the said Chelsea Ward,
on 2016 Ford, East River District, County of Mercer, State of West Virginia. Prosecuting
Attorney waiving notice thereto.
After hearing all the evidence in the case and it appearing to the Commission that the
property assessed for $4080 class 3 in Summers County and Mercer County. It is therefore
ordered that Chelsea Ward be exonerated from the payment of taxes, or if the taxes have been
paid, shall be refunded by the Sheriff of Mercer County on such erroneous assessment.
Amount of Exoneration $115.84
RE: EXONERATION OF TAXES – JOSEPH SR. & ELAINE SIMMONS
This day came Joseph Sr. and Elaine Simmons, by representative, and moved the
Commission to correct the Personal Property for 2022, touching the assessment thereon against
the said Joseph Sr. and Elaine Simmons, East River District, County of Mercer, State of West
Virginia. Taxpayer turned in vehicle assessment card, it was left off tax ticket. Prosecuting
Attorney waiving notice thereto.
After hearing all the evidence in the case and it appearing to the Commission that the
property should not have been charged interest on supplement ticket. It is therefore ordered that
Joseph Sr. and Elaine Simmons be exonerated from the payment of taxes, or if the taxes have
been paid, shall be refunded by the Sheriff of Mercer County on such erroneous assessment.
Amount of Exoneration $45.10
RE: EXONERATION OF TAXES – MARGARET L. BRISBOE
This day came Margaret Brisboe, by representative, and moved the Commission to
correct the Personal Property for 2021, touching the assessment thereon against the said
Margaret L. Brisboe, on 2017 Jeep, Rock District, County of Mercer, State of West Virginia.
Prosecuting Attorney waiving notice thereto.
After hearing all the evidence in the case and it appearing to the Commission that the
taxpayer paid twice on assessed Jeep. It is therefore ordered that Margaret L. Brisboe be

exonerated from the payment of taxes, or if the taxes have been paid, shall be refunded by the
Sheriff of Mercer County on such erroneous assessment.
Amount of Exoneration $186.19
RE: EXONERATION OF TAXES – CAMMIE HALL
This day came Cammie Hall, by representative, and moved the Commission to correct
the Personal Property for 2022, touching the assessment thereon against the said Cammie Hall,
on Mobile Home, Beaver Pond District, County of Mercer, State of West Virginia. Prosecuting
Attorney waiving notice thereto.
After hearing all the evidence in the case and it appearing to the Commission that the
Mobil Home that was assessed for $10,850 Class 2 was paid on twice. It is therefore ordered that
Cammie Hall be exonerated from the payment of taxes, or if the taxes have been paid, shall be
refunded by the Sheriff of Mercer County on such erroneous assessment.
Amount of Exoneration $144.48
RE: EXONERATION OF TAXES – CAMMIE HALL
This day came Cammie Hall, by representative, and moved the Commission to correct
the Personal Property for 2020, touching the assessment thereon against the said Cammie Hall,
on Mobile Home, Beaver Pond District, County of Mercer, State of West Virginia. Prosecuting
Attorney waiving notice thereto.
After hearing all the evidence in the case and it appearing to the Commission that the
Mobile Home that was assessed for $4770 Class 4 was paid on twice. It is therefore ordered that
Computer Softw be exonerated from the payment of taxes, or if the taxes have been paid, shall
be refunded by the Sheriff of Mercer County on such erroneous assessment.

On the 16th day of June, 2023, before the Mercer County Commission, came the matter
of the Estate of Barbara V. White (Rice), deceased, upon motion of Terri C. Blankenship,
Executrix, requesting that a copy of the Last Will and Testament of said estate be accepted for
recordation.
After discussion and review of this matter by the Commission, upon proper motion and
second, and it appearing proper to do so, the Commission ORDERS that the copy of the Last
Will and Testament of Barbara V. White (Rice), deceased, be admitted to record.
All of which was accordingly ADJUDGED and ORDERED. The Clerk of this
Commission is DIRECTED to take whatever actions he deems necessary to effectuate this
Order.

Commissioner, the Commission voted to approve the Glenwood Park Amphitheater Project,
Main Street Builders pay application #4. Funding in the amount of $37,566 will be taken from
American Rescue Plan. Gene Buckner, Commissioner, opposed.
RE: FUNDING REQUEST – 2023 BLUEFIELD RIDGE RUNNERS RADIO
BROADCAST SPONSORSHIP PARTNERSHIP BASE HIT PACKAGE – 48 GAMES
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve the funding request from the
2023 Bluefield Ridge Runners Radio Broadcast Sponsorship Partnership Base Hit Package.
Funding in the amount of $720 will be taken from Video/Lottery.
RE: EXECUTIVE SESSION
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to go into executive session. On motion of
Greg Puckett, Commissioner, seconded by Bill Archer, Commissioner, the Commission voted
unanimously to come out of executive session and go back into regular session.
RE: REAL ESTATE – BRIAN COCHRAN – S. WALKER STREET
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to give Brian Cochran the ability to enter a
notice of public auction for two properties on the 100 block of S. Walker Street owned by
Mercer County, prequalifying minimum bid of $500,000. To bid, a $20,000 refundable deposit
with a letter of intent will be required with financial information as requested. Mercer County
Commission has the right to reject bids that do not meet requirements. Bidders must give a prebid notice.
It is ordered that this Commission be and is hereby adjourned until Tuesday, June 27,
2023.

Commissioner, the Commission voted unanimously to approve the creation of two new funds,

061 and #062, for the diversion of a portion of the transfer tax on real estate. Starting July 1st

2023, the state portion will be reduced to $.77 from $.88, the $.22 from the states portion to
General county will remain the same, which will leave $.11 to be divided between #061 Election
fund and #062 Record Room fund.

SERVICE DISTRICT

Commissioner, the Commission voted unanimously to approve the funding request from the
Mercer Public Service District, Mike Kennett, Chairman. Funding in the amount of $572,215
will be taken from the American Rescue Plan for the Matoaka Sewer Plant Upgrade.
RE: FUNDING REQUEST – MERCER DAY REPORT CENTER
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve the funding request from the
Mercer Day Report Center. Funding in the amount of $3,290 will be taken from Courthouse
Equipment for the purchase of two laptops from Dominion Systems.
RE: FUNDING REQUEST – MERCER COUNTY SHERIFF’S TAX OFFICE
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve the funding request from the
Mercer County Sheriff’s Tax Office. Funding in the amount of $28,279.64 will come from
Postage and $6,889.53 will come from Courthouse Equipment for a total of $35,168.17. Funding
will be used to pay invoice from Software Systems, Inc. to process and mail 2023 Tax Tickets.
RE: FUNDING REQUEST – MERCER COUNTY EMERGENCY MANAGEMENT
This day on motion of Greg Puckett, Commissioner, seconded by Gene Buckner,
Commissioner, the Commission voted unanimously to approve the funding request from the
Mercer County Emergency Management, Keith Gunnoe, Director. Funding in the amount of
$7,393.90 will be taken from Courthouse Equipment for the purchase of two radios, chargers and
mics.
